FOX had every chance to exercise their legal rights BEFORE the first frame of film was ever exposed. They clearly were using a Wait-and-See tactic in order to determine how much money thy could "earn" if the movie was expected to be a hit. If they knew the movie would flop, then meh, no biggie.
