The Supreme Court has turned down an emergency appeal from a New Jersey man named Leo Donofrio of East Brunswick, N.J., who says President-elect Barack Hussein Obama is ineligible to be president because he was a British subject at birth.

The court refused to comment on its order Monday rejecting the call by Mr. Donofrio to intervene in the presidential election.

Donofrio says that since Obama had dual nationality at birth _ his mother was American and his Kenyan father at the time was a British subject, he cannot possibly be a "natural born citizen," one of the requirements the U.S. Constitution lists for eligibility to be president.

Donofrio also contends that two other candidates, Republican John McCain and Socialist Workers candidate Roger Calero, also are not natural-born citizens and thus ineligible to be president.

At least one other appeal over Obama's citizenship remains at the court. Philip J. Berg of Lafayette Hill, Pa., argues that Obama was born in Kenya, not Hawaii as Obama says and the Hawaii secretary of state has confirmed. Berg says Obama also may be a citizen of Indonesia, where he lived as a boy. Federal courts in Pennsylvania have dismissed Berg's lawsuit.

There is precedence in this case from a case in 1866 United States vs. Rhodes Case No. 16,151. This means that a natural born citizen has to be born in the US and both parents must be US citizens, otherwise the child would have dual citizenship and would be subject to a foreign power.

Leo Donofrio began this project because he was angry that Congress has voted to allow John McCain to be eligible to run for President. He then began examining Obama to find good reasons to vote for him and in the process learned that he is not a natural born citizen in the strict sense of the term, as John McCain also is not, and found that another candidate running in some states, Roger Calero, is neither a natural born citizen nor a citizen of the United States at all.

Donofrio's case and Berg's case are often linked in the media but they ARE NOT THE SAME. Donofrio simply does not dispute the legality of Obama's birth certificate. He does not need to do so in order to demonstrate that Barack Obama and John McCain also for that matter, neither are natural born citizens.

Until the U.S. Supreme Court listens to the facts presented by both parties and makes a ruling on this issue we the people by signing this petition refuse to recognize Barack Hussein Obama as President of the United States of America because we believe he is not a natural born citizen and therefore uneligible according to the U.S. Constitution.

The unethical that the U.S. Supreme Court refuses to even discuss the many lawsuits recently filed by Leo Donofrio, Philip J. Berg, Alan Keyes and many others.

We feel that this is one of the most important Constitutional issues of our time and the media refuses to discuss it.
