While I see nothing at all wrong with basing a country's laws on the religious traditions of its citizens (like the US has) I do hope that some manner of saving this man's life may be found that is consistent with the traditions of the emerging Afghanistan law. Perhaps he can simply lose his custody case or be fined perhaps. It seems to me this would be a fine time for the Afghan government to set a new, humane, yet traditionally-consistent statute with regards to cases like this.

Why would anyone want to consider enjoining themselves to such a practice unless by duress? It is true - democracy incorporates freedom of religion, else it will NEVER work.
