We the undersigned request repeal of RCW i901 banning public smoking in the state of Washington, which became effective December 8, 2005.

This is an unconstitutional law, in effect telling business owners what they can and cannot do with their privately owned property.

Notification at the entrances of businesses that the environment is "NOT SMOKE FREE" should be sufficient warning to all who do not wish to enter.

Furthermore, if a business provides a designated, enclosed and properly ventilated smoking room, this should be considered sufficient to protect the public and other employees from the second hand smoke.

It is ludicrous to think that smoke will enter a building from outside as most if not all buildings now have "controlled environments". No windows open and doors are not open long enough to allow the smoke to enter the building.

This law infringes on the basic rights of all smokers. Tobacco products are legal for anyone over the age of eighteen, yet the state of Washington has made the use of those products illegal anywhere but in the private homes of smokers. Those smokers pay a hefty price in taxes for their cigarettes and tobacco products, filling the coffers of the state of Washington with $363,548,781.00 in fiscal year 2004. There has been an additional tax increase since then.

i901 is a very unfriendly way to treat those who contribute nearly half a billion dollars each year to the state and it deprives all smokers of their right to life, liberty and pursuit of happiness.
