To ANYONE that might be concerned about CHILDREN,

My name is Cynthia, and I live in Cookeville TN, and have been a resident of TN all my life. I’m now 33 years old. I have 3 children, my oldest is a girl that will be 13 in Feb., a boy who is 10 and my youngest boy just turned 9. I do not even know where to begin except to say that I am ANGRY with our state's lack of concern for children.

My former husband whom I was with for 17 years, BEAT me and the children. He placed us in a VERY controlled, very strict environment, and on top of that was arrested in February 2005 for 17 counts of Statutory Rape of a 14 year old child. He actually started kissing this girl when she was ONLY 12 years old!! He ONLY spent 11 months and 29 days in jail for this after accepting a plea of 4 counts! (Again, all documented) His children do NOT want to see him, and have seen over 10 therapist who ALL say that he shouldn’t be allowed to see them. The therapist say that it is DETERMENTAL to the well-being and that there is irreparable damage that has been done to them. However, the COURT says that he has every right to see them EVEN IF IT IS EMOTIONALLY AND MENTALLY DETREMENTAL TO THEIR HEALTH. Even when the COURT KNOWS he had sex with this 14 year old girl in a sleeping bag RIGHT NEXT to his (at the time) 7 year old son who SAW IT HAPPEN. We have reports from EXPERTS in the field of Child psychology that say they should NOT see him or that it would cause “Irreparable mental and emotional damage to the children”. (documented as well) We also have reports from HIS psychologist that state he is at a “High Risk (86%) of committing the SAME crime AGAIN against a child. If the ONLY children he is supposed to be around are ‘his’ children, WHO do you think his next VICTIM is going to be???

In the 36 codes of the TN law (TN Code 36-6-301) states the following: (just so you the reader knows that I have SOLE custody of the children)

“After making an award of custody the court shall, upon request of the non-custodial parent, grant such rights of visitation as will enable the child and the non-custodial parent to maintain a parent-child relationship unless the court finds, after a hearing, that visitation is likely to endanger the child's physical or emotional health. In granting any such rights of visitation, the court shall designate in which parent's home each minor child shall reside on given days of the year, including provisions for holidays, birthdays of family members, vacations and other special occasions. If the court finds that the non-custodial parent has physically or emotionally abused the child, the court may require that visitation be supervised or prohibited until such abuse has ceased or until there is no reasonable likelihood that such abuse will recur. The court may not order the department of children's services to provide supervision of visitation pursuant to this section except in cases where the department is the petitioner or intervening petitioner in a case in which the custody or guardianship of a child is at issue.

ALSO: Code 36-3-601 says: As used in this part, unless the context otherwise requires:
(1) “Abuse” means inflicting, or attempting to inflict, physical injury on an adult or minor by other than accidental means, placing an adult or minor in fear of physical harm, physical restraint, or malicious damage to the personal property of the abused party;

The children are afraid and have told numerous therapist that they are scared that he "might do the same to them, that he hurt them, that he was mean to them and their mommy, that they are SCARED."

So why is it that our court system STILL is trying to MAKE the children see their father when they have NO desire to see him? Why are judges allowed to IGNORE the above laws? The courts in our ‘small town’ has the “good-ole boy” well at work, and I think that this process of FURTHER damaging children is WRONG!!! Is it not the efforts of our government to in-act laws to protect the children EVEN FROM THEIR PARENTS?

The problem I think is the ‘courts’ and law makers do not have to “HOLD and COMFORT” the children like my husband and I do after the CRYING and NIGHTMARES they have out of fearing that their father will do “bad touches” to THEM they way he has already did to ANOTHER CHILD! They have seen him twice because the judge ordered it as therapeutic visitation for their father....NOT them!!!! He should have NO rights!!! These two visits affected their health, grades, sleep and eating. They regressed back to little children....I have letters from their teachers all saying how the children went into shells and would not participate with the class. These CHILDREN are screaming out for SOMEONE to help them.....WHY will no one listen.....as a mother I am HURT, SADDENED, AND ANGRY that my babies are suffering because of his sin, his lack of compassion for a child, his "lust of the flesh", his SICKNESS!!! How can someone rape a child 17 times?!?! And above all, the state says HE HAS a right to be with children????

When are we as a society going to STAND UP FOR THE CHILDREN who do NOT have a voice in a court room because of their ‘age’? I KNOW that common sense SHOULD play a part here. I believe that ANYONE that would commit a SEX ACT with a minor child shouldn’t have access to ANY CHILDREN. What are we thinking by placing MORE children in the snare of a KNOWN and SELF ADMITTED CHILD RAPIST???

I have made it my mission in life to POUND your halls at the state until I get SOMEONE who listens to the CHILDREN and will stand up and create a law that known sex offenders aren’t allowed around their children AT ALL UNLESS there is an obvious parental bond and the CHILDREN WANT to see their parent!!! We as adults have our own problems, but children should not be FORCED into seeing a SEX OFFENDER that they DO NOT want to see!
