Petition for Release From Prison

My husband was sentenced in Hillsborough County on August 28th 2006 to a three year prison term for a crime commited in 2000. The following information was not considered in court, I feel if it had the outcome would have been different. It is true that my husband's past is not pretty, but it was 16 years ago in his adolesence. Should a persons' past, especially in a unique case such as this, deem them guilty until proven innocent? With the exeption of this matter,and a mistake by D.O.C. in 1998 where he was incarrcerated but do to the circumstances granted emergency release, he has not had a felony conviction since 1991. Some people really can change.

We met in 1998 and we were married in 2000. I have never known him to be the person reflected in his past record. We have had 3 children together, in addition to the 14 year old son he has from a previous relationship and the boy we adopted who is now 16. He has always been the sole provider as he is "old fashioned" and in the last few years also became the provider for both of his parents as he is an only child. He is the owner and opperator of a fifth generation family business (Barton's Tree Service). He held the contract for The City Of Zephyrhills, Hillsborough County Housing Authority, Hillsborough County School Board, Hillsborough County Sherrif's Department and Hillsborough County Road and Street Department. He was a member of the Zephyrhills Chamber of Commerce, Hillsborough County Chamber of Commerce and The Better Business Bureau. He donated a pick-up truck load of toys to the children with aids in Tampa General Hospital, hundreds of dollars of school supplies to The City of Zephyrhills Police Department and delivered meals on wheels to the elderly. He has also worked for free for elderly people who could not afford the neccecary tree work because of a fixed income, for our church removing a large oak tree out of a mobil home for a single mother, and for The City of Zephyrhills Fire Department removing trees out of homes when they were ill equiped. He has a very big heart and just cannot turn away a person in need. He has taken in countless people who were down on their luck. He would feed them, let them take a bath, give them pillows and blankets and let them sleep at our shop, then give them a job working for him and pay them the same as any other employee. He never asked for anything in return, other than to not be stolen from. A few years ago he met a man that was an attorney but had made some bad choices and been disbarred. He was having financial trouble and had very low self esteem, he didn't think he could ever get his life back. William gave him a job as an estimater and they became close friends. This man said that William Barton made him feel like a man again. He said William gave him the support he needed, which boosted his self esteem. He has since taken care of his problems and returned to practicing law. He says he can finally walk with his head held high. His name is Mike Jones and he has volunteered to make a notarized and/or recorded statement, if you so wish. He is a wonderful father and great roll model. He teaches the importance of honesty, morals, pride, education and most of all family to all our children. He teaches them how to(as men) stand up and provide for their family instead of being lazy and waiting for someone else to. He has a very special and strong bond with all of them. He asks our 4 year old daughter Lillian Grace "where's your daddy?" and she says "on my pinky". We are all suffering tremendously and really need him to come home. I have lost my home and my vehicle, I cannot work due to all the major health issues that have come up in the past few months, the business he worked so hard for is going under and fast, his parents have almost zero income and worstening serious health issues. The children have never been away from him longer than 8 days since the day they were born which is resulting in very high stress levels and behavior problems. I do all I can to relieve it, but the only thing that will is his daddy coming home. William is a very loved and valuable member of society. With all his good doing I can't help but wonder what purpose he could have in prison, not to mention the drain on taxpayers to house him and to provide the kids and me the help we need to survive when he has always been more than willing to support us. He can repay his debt to society much better as a free man than he ever could in prison. It is for all these reasons that I beg for your mercy. We are willing to accept any conditions deemed necceccary for him to be released, ie: house arrest, probation and $10,000 restitution (or any $ amount appropriate) and communtity service. Anything. Please help! I greatly appreciate you taking the time to read and consider this letter.

with out knowing what offense your husband was convicted of,I can only offer you my prayers and sympathy.Although you's is a tough and touching story,and your husband does sound like a careing person.I think that as flawed as our legal system might be,it is the only one we have.Maybe you and this lawyer can still run your busniss by hireing subcontactors.And with good behavior you can pettion for early release.God bless,tom chicago.
