IRS rules and regulations, while well intentioned have followed the law of unintended consequences and created a mess that we refer to as the 403(b). In the name of compliance, school districts throughout the United States are spending millions of dollars to attempt to comply with regulations that add no value to the participants retirement balance.
We believe in compliance and urge the IRS to Free the 403(b) from its current regulatory shackles. Our goal is to create a compliance regime where the IRS grandfathers all 403(b) contracts as of a specific date (say 12/31/2010) and require compliance on a go-forward basis.
