Be it know, the undersigned persons seek immediate reimbursement from GILD for shipping charges assessed on a download product. The undersigned also seek the dissolution of the company doing business as GILD, releasing all artists from the contractual obligations with GILD (the company) allowing them to pursue more suitable distribution and representation for their artwork in the PSP community. The purpose for requesting dissolution of the company are stated below.

The mission statement for the company states their interests lie in protecting the artists rights and interests and the pursuit of preventing illegal use of artwork. Taggers worldwide have worked hard to be copyright aware and to inform others that have web sites to use copyright OK artwork or to obtain proper licensing. The company has stated that copyright violations of works by artists contracted with the company are to be reported to the company. They would then pursue the violators to remove the offending artwork or the offenders would suffer legal action. Reports to the company of copyright violations by taggers and other interested parties have been ignored. The is a blatant show of disrespect to the artists the company represents.

It must be stated that the company has exhibited poor to non-existent customer service. Issues and genuine concerns of the customers are not addressed in a timely manner or go completely unanswered. This can be said for phone calls made to the company or e-mails sent to the company. At the inception of the company in late 2004, terms of use were established (TOU) and internet groups were formed to make important announcements, allow customers a place to congregate and ask questions. The groups that were formed were not mandatory nor did they require participation. Since late 2004, the TOU have changed several times and the groups required participation to remain a member. Additionally, questions were deleted couched with a statement "we are not the company's customer service".

The purpose of forming the company was to allow use of artists' work by the tagging community. The focus was the artist and their work. A key TOU change was to NOT put the artist URL on a signature tag and to place the acronym GILD on all tags. This change takes away one of the original the purposes of the company. This is merely advertisement for the company instead of the artists websites.

Another purpose of the company was to provide quality artist product for taggers. The quality of the images and tubes make them difficult to use. And the current situation is that "tubed" product is incomplete. Access to the product is delivered via the company's web site, which is difficult to navigate and understand.

Another purpose of the company was to bring an income to the artists. The company's web site was not accessible for nearly 5 months, making it impossible for taggers to purchase product that generates income to the artists. It is our opinion that this is a breach of contract/promise to both taggers and artists as promises were made to have these available at all times and new releases coming on a regular basis.

At the inception of the company, there was one main agent, Philip Rose, and several associates that acted is management in the afore mentioned groups that were formed. Mr. Rose has been nearly unapproachable. Some management have attempted to be of assistance but overall have shunned pleas by customers/taggers for help.

The company had incentives in the groups for the members where they could win/earn free product/packages. There was also a frequent buyer rewards program. The rewards and incentives were time-sensitive and needed to be cashed in by a certain time. This was not possible as the company web site went "down" and remained "down" for several months. Hundreds of taggers lost out on product they earned. Attempts to recoup the rewards have been dismal.

All these concerns have been asked of management in groups only to have their posts deleted. Therefore, customers lost their proof of request. Taggers feel they have been lied to and that our intelligence has been insulted time and time again.

I think the GILD are rotten to the core. Philip is dishonest and treats people with no respect at all. I feel bad for all of us that trusted in the GILD I also feel that the artists werent represented at all. I believe that the monies that this horrid person made from us should be returned. I feel that we as people have the right to sue the GILD for the injustice that it has caused to all of us. Thank you

The artists do a great job and their source of income has been compromised. How the heck can someone let that go, bah, crappy company and the artists need to be able to drop them like a bad habit. That is a total breach of contract and financially should be obligated to repay the artists for the income loss from this incident.
