My experience mirrors everyone else's. I received 5 damaged posters from Adam Hersh and sent them back, never receiving replacements. Paypal won't honor my claim against them because I didn't get a tracking number for the posters I sent back. I now have no posters and spent $25 on shipping and $20 on posters. Adam Hersh is a fraud. I was the winning bidder on a $.99 poster ($7.99 S&H) on May 11, 2005...it is May 10, 2006 and I still don't have this stupid poster. I have emailed this fraud NUMEROUS times and tried to call as well. When I am fortunate enough to get a response I am told that the poster was damaged during shipping and they will send me another one. It's been a year, WHERE'S MY FRIGGIN' POSTER? Then when we (the customer) get feds up with the conflicting stories and either asks for a refund or reports to paypal or ebay..they are then ignored by Adam Hersh Auctions. When appropriate feedback is left this seller replies with negative feedback on the buyer even if the buyer paid for item within minutes of the auction ending. Ebay is also partly to blame for this because they are allowing it to continue. Will definitely report this poor business practice to paypal,ebay and BBB.

I support this petition. I won the auction on Dec. 6th, 2005. Paid on Dec. 7th. Got a canned email on Dec. 16th saying item was shipped. It's now Dec. 29th, still no item. All attempts at contact get a canned email response. I too anticipate getting negative retailiatory feedback when I leave him his well earned negative feedback. Lousy seller with poor communication and exorbitant shipping costs! A look at his feedback history shows many complaints about never receiving the item and him using negative feedback as retaliation. 3800+ total negative feedback and 3200 of it earned in the last 12 months! I, like many others, made the mistake of not reviewing their negative feedback before bidding and paying for a Christmas gift for my husband on Nov.8th. Product never arrived, i emailed several times, finally got an answer that my poster was damaged and they would reship at no cost to me since it wasn't my fault. Wonderful. Still in time for Christmas, right? Wrong. Still never received, again emailed them numerous times. No product. Warned I would have to give negative feedback, they simply sent me the same auto-email they sent me a month ago. It's now the end of December, no product, no refund. I also see another person was told their item was damaged and would reship, but they didn't receive anything either. Apparently this is a SCAM. I guess I've joined the ranks of the Adam Hersh victims. I just wanted to add that I have filed a formal complaint with the FTC Internet Fraud Division. Adam Hersh emailed me today and said that they could not complete our transaction until we removed the complaints from PayPal and eBay. We emailed back and told them that they either complete the transaction or we will file a class action lawsuit against them along with other victims of his scam. i was one of the stupid people that bid on a picture from this joker! Yeah the postage was on the page but it was WAY AT THE BOTTOM and who would think some person would charge $30.00 for postage on a .99 cent item. He has now cashed my money on 11-5-05 so lets see how the product arrives.

I looked at a framed poster to purchase for .99. When I checked to see what shipping would be I came up with the following:
U.S. Postal Service 1st Class $31.98
.S. Postal Service Priority Mail $101.98
U.S. Postal Service Express Mail $1751.99
There is NO WAY that a poster would cost that much to ship. Not even computers or gym equipment is $1700!! I can't believe thos guy is allowed to sell anything and should be banned!
I won several posters from Adam Hersh for between $.99 and $9.99, but after incredibly high shipping and insurance my total reached almost $100.00. When I finally recieved the posters some three weeks later more than one of them was bent and one was ripped. After reading the comments of others I am positive that this company is fraudulent and should be removed from overstock.
I won 2 posters one for .99 and one for 2.01 after they added the awfully high shipping and insurance, my total was 15.96. After several unanwered emails and weeks of waiting, I received only one poster. The packaging was not as stated on the auction. "You are looking at a great poster. The poster measures approx. 24" X 36" and is perfect, unused, and rolled in a plastic protective tube." It was in a plain brown paper roll thinner that what the toilet paper comes on. Because it was so thin and weak the package and the the poster were damaged. I contacted ebay and filed a disput with them. I left negative feedback for them; therefore, they left this for me. "We resolve all issues - Buyer well informed still left neg! POOR!" I did not deserve that. I paid right away at the end of the auction. I did get a refund through ebays efforts after I had to buy another undamaged container and pay for shipping to send it back to them. Because I left the word sh**, in the feedback form without knowing it was against the rules, ebay removed the two negative emails I left; but, did not remove the unfair negative remarks they left for me. As far as their insurance policy goes, we pay 1.99 for insurance on our items that even with shipping costs they are still making money. I feel that this company is fraudulent and should be removed from ebay.

I wrote through eBay to ask Hersch to consider UPS shipping and received only garble answers. I refuse to pay the exorbitant shipping.

Well, I bid 9.99 for a "Framed Poster", then noticed the "34.99" shipping charge. Received the poster(Shipping label: $1.75) but, of course, have still not (11-02) received the frame (Auction closed 10-12). All I get are autoresponses.
This guy's doing a one man volume resale operation and can't handle the automation. If something goes wrong, he just ignores it and browbeats complainers with negative feedback (to keep them quiet or get them to withdraw any negatives they've left).
He should be banned, fined and put in jail.

I purchased eight items from Adam Hersch all at the same time. I was charged thirty dollars and some change for shipping. I received seven items in one package, never received the other, and the postage was clearly posted outside of the package - $4.00!!!! I am very displeased with this person and would like to request a full refund. If anyone can tell me how to go about getting a refund on the postage, at least, i would appreciate it.

This guy had 72 negative ratings in a VERY short span of time and as a seller I must say this is outrageous. I contacted Overstock about him to help my friend. They said they were looking into it and nothing has ever been done. He tells you that payment must be made within 20 days however, he will file a NPB report after only 13 days! Hello,just like everyone else I got ripped off by adamhersh.I won`t rehash what everyone else is saying. Today I filed a complaint with the IFCC Internet fraud commision. He is charging everyone for mandator insurance but not getting it. Every delivery should have a insurance sticker. If not,this is internet fraud. Actually,ebay knows that this is going on. Co-cospirtitors?
Bought a poster, after several weeks I sent 7-8 emails, only after I threatened "Very Negative" feedback did I get a response, they told me a BS story that it had been shipped but that the USPS destroyed the item and sent it back to them (this doesnt happen) Today I again emailed them with a date, if it doesnt arrive by then I WILL be ripping them to shreds in their feedback.

bought a poster for 1$, only finding that shipping would cost 120$.i asked if it could be delivered to a relative in the USA and there was no reply except an automated respnse saying "thank you for your question/comments. i cant get hold of them and now may be suspended from ebay
He doesn't respond any of the questions.
No respond to disputes.
No respond to e-mails.
He doesn't have phone assistance.
MOREOVER LEAVES NEGATIVE FEEDBACK !!!
Won two 99¢ posters. On attempting to pay with PayPal through his checkout system, the shipping charge was US$1499.99 plus mandatory insurance. My emails requesting clarification of this shipping amount went unanswered. Now has left negative feedback and filing disputes (for non-payment strikes) with ebay. Further investigation shows that he is a "Trading Assistant" with ebay. Ebay is protecting this guy. He is in clear violation of ebay's policy on "Excessive Shipping & Handling"; not to mention, how does someone with 3126 negative feedbacks (not counting the many more mutually withdrawn) remain on ebay?
