Life, liberty, and the pursuit of happiness; this is what is promised us as American citizens, and for those around the world, it is what draws them to our shores. For over two centuries the American experiment has flourished with the idea of the American dream, where if you work hard and obey the law the limit of your success is only bound by the limits of your imagination. The humblest of these ambitions is that of owning your own home, your own piece of land. Property ownership is one our most valued rights as American citizens; a place to call your own, to raise your family, and pass on through the generations.

Now it would seem with the United States Supreme Court Decision in KELO ET AL v. CITY OF NEW LONDO (NO. 04-108), June 23, 2005, that dream can be wiped away at the whim of any local government for economic reasons. In this case a group of homes, in good condition and in a good middle class neighborhood are to be condemned because the City of New London can get higher tax revenue and more jobs by giving that land to another “private owner”. In more simple terms, they are taking citizens perfectly good homes, and selling the land to another private entity, so they can receive higher taxes on the land. This decision clearly redefines the fifth amendments definition of “public use”. It would seem that the Supreme Court, in it’s 5 to 4 decision, believes “public use” is whatever a government sees fit it to be. This decision leaves citizens with little recourse against government seizure of our private property.

We therefore respectfully request and encourage our State, The Commonwealth of Massachusetts, to severely restrict these seizures. We appeal to the Massachusetts State legislators to join eight other states in our nation, Washington, Montana, Illinois, Kentucky, Arkansas, Maine, South Carolina, and Florida, to enact legislation where the use of eminent domain for private development is all but prohibited.
