In 2006
In November of 2006, Gerald Williams was accused of using a false date of birth to obtain a second driver’s license on March 16, 2006, because his first license was allegedly revoked on September 30, 1989.
November 13, 2006 in a letter, the Secretary of State said “our records indicate you are ineligible for a driver’s license because your license were revoked when you last made application for a driver’s license (which was March 16, 2006).”
But on March 16, 2006, the Secretary of State’s records prove that my driver’s license Wxxx-xxxx-1126 was not in revocation status and that is why I was approved the issuance of my license on March 16, 2006.
The accusatory letter goes on to say “You were able to obtain this license ONLY because the identification you provided to verify your name and/or date of birth was different that it appeared on you original file.” SEE EXHIBIT A PAGE 134
This is false, because my name and date of birth are exactly as they appear on my original file (SEE EXHIBIT C PAGE 152). And the identification I provided to verify my name and/or date of birth was my previous Illinois driver’s license (SEE EXHIBIT K ON PAGES 70 AND 120 for January 29, 2003; PAGES 87 AND 98 for March 16, 2006). Since August 5, 1987 I have always used my previously expired or soon to expire license (Wxxx-xxxx-1126) as identification.

In 2007
On January 9, 2007, Gerald Williams had proved that that he had not used a false date of birth to obtain a license, but he had no explanation for the license bearing the erroneous DOB March 2, 1971. The Secretary of State even accused Gerald Williams of giving the Chicago Police the March 2, 1971 DOB which is also false. Gerald Williams swore he had never knew of, never seen nor held a driver’s license with the March 2, 1971 DOB.
But Secretary of State’s Hillary Price-Cohen under oath says “… and WE (self-including herself) noticed the same picture of the same person (Gerald Williams) with two (different) driver’s license numbers and two (different) dates of birth.” SEE EXHIBIT L PAGE 140. This is false. Only one license actually exists. Perjury! There is no pictured license of me with a March 2, 1971 DOB.
The Secretary of State’s Hillary Price-Cohen also professes that Gerald Williams was FIRST issued driver’s license Wxxx-xxxx-1064, then using the DOB May 2, 1971, obtained a SECOND driver’s license Wxxx-xxxx-1126.
The Secretary of State’s Hillary Price-Cohen clarifies “FOR THE RECORD” saying, “we are here because this gentleman has two driver’s license numbers. He has one number Wxxx-xxxx-1126, with a DOB May 2, 1971. That was issued on January 29, 2003. Before that, he had a driver’s license number of Wxxx-xxxx-1064 and with a date of birth of March 2, 1971.” False! SEE B14 AND B15 ON PAGES 137 AND 138
The Secretary of State’s Hillary Price-Cohen also supports her accusation of Gerald Williams “premeditated criminal intent” in saying, “you (Gerald Williams) went into the Secretary of State office and you gave them your name, BUT you gave them the date of birth May 2, 1971 and they issued a second license to you.” SEE EXHIBIT I ON PAGE 139. And this too is false.
In the midst of all of this falsehood Gerald Williams thought that his birth certificate bearing his correct DOB as May 2, 1971 would shed truth on the matter and resolve the situation. It only changed the Secretary of State’s reckless Path of Destruction.
At this point the Secretary of State didn’t think constructively, such as, cancel this erroneous driver’s license, rescind the revocation, let this man who has been driving for twenty years from August 5, 1987 to November 1, 2006 with no DUI’s, no speeding tickets, and no hazardous moving violations continue driving; a professional driver since 1994; M-class added in 1997; Star Truck Driving School “A student” graduate; upgraded to an A-class CDL in 2003; Advanced driver endorsements for Hazardous Materials, Tankers and working on Passengers road exam; and now earning nearly 60,000 a year and paying taxes as a professional driver; and a father of four small children between the ages of 1 and 9 who need food, clothing, shelter and entertainment and were attending tuition based private schools. Not only would that be the correct legal thing to do, it would have also been the correct moral thing to do.
But No! This “Terrorist Administration” decided to act destructively, unlike Jim Edgar’s in 1987. Even after proof of the perjury and the false accusation, the Secretary of State revoked Gerald Williams’ driver’s license for having a second license that they created. This caused Gerald Williams earning to go from 60 to 0 in the stroke of the “enter” button. Now Gerald Williams is suffering the proved burden of undue hardships because of this unwarranted revocation that he received for the Secretary of State’s 2006 false accusation against him; the loss of his home; the loss of his CDL? Why?; the loss of the ability to provide for his four children; humiliation; a defamed character because his driver’s license abstract now shows Gerald Williams as a person who falsifies documents; and an inability to continue working in his well established, 12 year, driving career profession. SEE PAGE 59. What did I do?
From that day forth I foolishly communicated with the Secretary of State, even Secretary White himself, in an attempt to get them to find a way to rescind the revocation because I swore I had done nothing wrong and I didn’t know where that license with the March 2, 1971 birth date came from but I was determined to find out. During that process I researched and found evidence that was “withheld during the hearing” that would prove that the Secretary of State in fact created and revoked the second driver’s license with the March 2 1971 dob in error in 1989, and they falsely accused, charged, convicted and executed me, for what they had done wrong.
The Secretary of State used a document containing false information in creating the second driver’s license Wxxx-xxxx-1064, without notifying Gerald Williams of this second license. SEE PAGE 70 AND PAGE 96. And Secretary of State did not cancel nor revoke Gerald Williams’ first driver’s license Wxxx-xxxx-1126 in 1989. There is no 1989 Notice of Revocation or Cancellation for Wxxx-xxxx-1126. And no 1989 Notice of Issuance of Second Driver’s License.

In 2008
In March of 2008, I obtained the evidence that proved this, the Cook County Circuit Court ORDER OF PROBATION for felony conviction case no. 89cr9712 People of the State of Illinois vs. Gerald Williams (no middle initial “J”), it’s dated August 22, 1989 and is signed by the petitioner, the judge and the state’s attorney and it clearly shows my dob as 5-2-71. All communication with the Secretary of State’s Office ceased and I was referred only to Nathan Maddox. SEE EXHIBIT U1. April 16, 2008, the Senior Legal Advisor to the Secretary of State, Nathan Maddox, sent me a letter that I feel is like DNA evidence that would free an innocent man incarcerated, falsely convicted of rape. SEE EXHIBIT V1.
Senior Legal Advisor to the Secretary of State, Nathan Maddox, said “Regarding the actions of this office, our records show that we created a duplicate driving record for you driver’s license revocation because we received incomplete (incorrect/false) information from the court clerk.”

*reviewing court will presume circuit court’s (in this case the plaintiff’s) determination was correct when doubts arise because of (the Secretary of State’s) incomplete records*

(625 ILCS 5/6-302) Making false application or affidavit – Perjury. It is a violation of this Section for any person: 2. to accept or allow to be accepted any document displayed for the purpose of making application for a driver’s license permit knowing that such document contains false information concerning the identity of the applicant.

First of all Mr. Maddox should have said our records “now” show that we (Secretary of State) created the second license…, because of Gerald Williams’ disclosure legwork in investigating and exposing this abuse of authority; to defend his livelihood and his children’s well being. If your records showed that you created the second driver’s license in 2006 or in 2007, Gerald Williams would not have been accused of using a false DOB to obtain the second driver’s license that was actually created and revoked in error by the Secretary of State's use of a document containing incomplete (incorrect/false) information. (This is a violation of 625 ILCS 5/6-302.2)

And you did not create a duplicate driving record. A duplicate is an exact copy of the original. You created a fictitious driver’s license (625 ILCS 5/6-301.1-a1) with false information (625 ILCS 5/6-301.1-a2) that should have been cancelled (625 ILCS 5/1-110) not combined.

Mr. Maddox goes on to say “However, the information we received included your correct name and address, and we mailed notices to that address.”
This is false. Since August 5, 1987 my correct Secretary of State Computer file name has been “GERALD WILLIAMS”. My father’s Secretary of State Computer file name is Gerald “J” Williams. Mail from the Secretary of State addressed to me is addressed to GERALD WILLIAMS and mail from the Secretary of State addressed to my father came addressed to Gerald “J” Williams. At the age of seventeen, I had neither legal right nor parental authorization to open any mail from the Secretary of State addressed to Gerald "J" Williams. My parents were separated then and are divorced now. Any mail addressed to my father was forwarded to my father.
Mr. Maddox finally breaks it all down for us and says, “Therefore, had we received complete (correct/ true) information, notices of the revocation would have been sent to the ‘same name’ and place at the same time.”
Is the Senior Legal Advisor to the Secretary of State ignoring the fact that “Had they received complete (correct/true) information” from the clerk’s office in 1989, they “would have” revoked the correct driver’s license (Wxxx-xxxx-1126)? And they “would have” mailed notices under a different Secretary of State computer file name, “GERALD WILLIAMS” and not Gerald “J” Williams. I “would have” known about my projected eligibility for reinstatement date of September 30, 1990. I also “would have” had to have my driver’s license reinstated before having the privilege of being issued my 21 and over driver’s license in 1992, but this was not the case because my license (Wxxx-xxxx-1126) has never been revoked and I surrendered my under 21 driver’s license and was privileged to be issued my 21 and over driver’s license, legally from the Secretary of State, no problem! And I have been privileged to renew every four years thereafter!

This is the second time the Secretary of State has made an error regarding my date of birth. The first time was in 1987 when they used an April 2, 1971 DOB, but they cancelled it because of the errors (see exhibit C). Me and my family have been suffering undue hardship, for two years now, because my license were revoked for the Secretary of State’s errors and not my own. And the Secretary of State has been trying to drown out my voice to cover up this abuse of authority. JOIN MY VOICE!

By signing this petition against the Jesse White’s Office of the Secretary of State of Illinois, you agree that the Office of the Secretary of State was wrong in revoking Gerald Williams driver’s license in 2006, and should rescind the order of revocation for the false accusation of him using false information concerning his name and/or dob to obtain a second driver’s license. In addition to that you also agree that:

1. The Office of the Secretary of State owes Gerald Williams for damages.
2. The Office of the Secretary of State owes Gerald Williams his driving record restored to its original pre-revocation state.
3. The 2006 revocation action for the 1989 felony conviction against driver’s license Wxxx-xxxx-1126 should be barred from enforcement, because the Office of the Secretary of State failed to revoke Wxxx-xxxx-1126 twenty years ago, in 1989. The Office of the Secretary of State has completely ignored all statutes of limitations for this action.
4. The Office of the Secretary of State owes Gerald Williams the complete restoration of his CDL and a new driver’s license number.
5. Gerald Williams should be vindicated.
