The City Council is preparing to consider pending legislation in Bills #98, 37, and 86, all dealing with banning the use of motorized scooters in New York City. In its current form, the wording of these bills is sufficiently broad so as to effectively ban the uses of Segways as well.

A Segway is decidedly not a motorized scooter, and has not to date, proven to be unsafe or dangerous. The number of Segways in use at present in NYC is well under 100. The importance of allowing Segway use is severalfold: to give this innovative, environmentally sound technology the opportunity to be properly tested and evaluated for use in an urban environment; to provide the mobility challenged with a new, user-friendly and failsafe technology; to identify all potential applications and positive effects of this alternative technology. To ban use of the Segway would prevent this discovery.

The Segway is defined as an EPAMD – a self-balancing, non-tandem two wheeled device, that can turn in place, designed to transport one person, with an electric propulsion system averaging less than 750 watts (1 horsepower), the maximum speed of which, when powered solely by a propulsion system on a paved level surface is less than 12.5 mile per hour.

We ask the City Council to amend the definition of a motorized scooter to exclude the Segway, and to change the exclusion for disabled use to read, "for the purposes of this section, the term motorized scooter shall not include wheelchairs or other mobility aids used by person(s) with a mobility impairment as defined under the American's with Disabilities Act.”, reflecting wording which is more in keeping with standard reference to persons with disabilities.

We urge the City to work with the State Assembly to understand and to pass positive legislation for use of the Segway in New York State and City, and to provide hearings and commission reports on the Segway prior to any action restricting use. Please give Segways a chance.

I support this petition. One downfall of the segway is the normal model can only hold 230lbs and the big one can hold 250. What if you're fat?
