It is absolutely wrong what Shell is attempting to do. The Rossport 5. should be released immediately. Shell should construct the facility to refine the crude gas out at sea where human life would not be at risk. The Irish Government should make Shell/Statoil construct the refining plant at sea.

Like a lot of other Irish developments why haven't all the stakeholeders been consulted, and instead why have people had to go to jail when this could have been negotiated peaceable at far earlier stages. As usual the government at the whiff of a bit of money decide to railroad a project through, first the projects were at the cost of our natural and cultural heritage, and now our civil liberties and human rights. What's next I wonder? Fumbling in a greasy till, anyone? We really have become just a nation of shopkeepers

What's wrong with having a thorough going investigation of all the issues? I am an Health & Safety respresentative and it has always been good practice to resolve basic H&S issues before you proceed.There is clearly no doubt that local people will be impacted upon by this venture and their needs are paramount.

The Irish Government has a positive obligation under the European Convention on Human Rights Act 2003 to ensure the home and private rights of the Rossport residents whose health and safety are in question (Article 8 of the ECHR). See: Hatton and Others v UK, Judgement of 2/10/2001 # 36022/97 para. 98 This was the final case brought by residents living near Heathrow, who due to new flight paths, and flight times to/from Heathrow experienced levels of noise pollution. The Court found that their rights had been infringed because the State had not carried out the necessary research to assess whether there was a way of minimising the impact on these residents. The Court said: " … States are required to minimise, as far as possible, the interference with these rights, by trying to find alternative solutions and by generally seeking to achieve their aims in the least onerous way as regards human rights. In order to do that, a proper and complete investigation and study with the aim of finding the best possible solution which will, in reality, strike the right balance should precede the relevant project."
