Nate Kirk would speak out if he could but he was murdered.....
Robert Nathaniel Kirk was found in the shallow end of his pool just days after having his life threatened for protecting a friend. "Nate" as he was called was a typical teenager with the normal challenges our youth have today who would do anything to try and protect his friends.
Nate's death was ruled an accident and the law enforcement refuses to further investigate because of the Medical Examiners ruling. However, if you look at the photos of Nate, you will know beyond a shadow of a doubt that this was no mere accident, how is it that the Medical Examiner can miss all these massive bruises, cuts, abrasions, and massive head injury? Why was Nate wearing his clothes in the shallow end of the pool, socks, t-shirt and boxers?
Nate was just an average kid who was loved by his family and friends who loved to smile. Accident, NO WAY !!. Murder, YES.
Nate’s life was valuable. Every human life is valuable. .
Nate gave his life to protect a friend and now he needs you to help speak out to make sure those responsible for his death are brought to justice before they murder again.
Thank you,
Rev. Jim Wilson on behalf of the Kirk Family

Our hearts goes out to the families, as you know our ministry has taken a pro active stance in seeking justice for Nate but in light of new evidence that Jim Kirk intentionally left out or old evidence substantiated we have pulled our involvement from the case and ask that you continue to pray for the family during this most difficult time. God Bless -

Dear Gentlemen:
Thank you for your letters of July 3 and July 14, 2007 respectively. I certainly share your concern over the Kirk family’s loss of their son Nate. I can assure you that the Mesa Police Department (MPD) conducted a very thorough and complete investigation into the circumstances of Nate Kirk’s death and there is no indication that it was anything but an accidental drowning. However, let me take this opportunity to share the results of the MPD investigation with you so that you are fully informed of all of the facts and circumstances thereof.
On August 28, 2006 uniformed police officers from the MPD were dispatched to 1852 North Saffron Circle, located in the City of Mesa, on a medical call for a non-breathing male. The responding officers met with Nate’s father, James Kirk, who reported the incident. Mr. Kirk advised the officers that he found his son floating in the shallow end of the pool at approximately 8:00 a.m. Mr. Kirk also indicated to the officers that he pulled his son from the pool and contacted 911 emergency communications to request assistance.
Mr. Kirk provided the officers with an accounting of what had transpired prior to his finding his son’s body. He told the officers that Nate had been at an acquaintance’s house the night before and arrived home at approximately midnight. Mr. Kirk also told the responding officers that when he woke up that morning he went to Nate’s room looking for him. Mr. Kirk told the officers that he noticed Nate’s pants in the bedroom with his wallet and cell phone still in the pocket. Mr. Kirk then told the responding officers that he went out the front door and walked around to the side gate. Mr. Kirk said that he noticed the side gate was slightly ajar. Mr. Kirk told the officers that he then walked to the back yard and found his son in the pool.
Mr. Kirk provided the officers with background information concerning Nate, which included previous threats of suicide, depression and heavy drinking, for which Nate received treatment. Mr. Kirk also told the officers that Nate was bi-polar and was taking medication, Depakote and Seroquel. Mr. Kirk also told the responding officers that Nate may have been provided with illegal drugs while he was at his friend’s house the previous night.
Emergency personnel from the Mesa Fire Department (MFD) also responded and pronounced Nate Kirk dead at the scene.
Also, the Office of the Medical Examiner responded to the scene and did not find any evidence on Nate’s body indicating foul play. Nate’s body was then transported to the Medical Examiner’s Officer.
The responding officers examined the scene and saw no indication of a struggle in and around the pool area.
Based on the circumstances, a detective was not dispatched to the scene because there was no indication that Nate’s death was anything but accidental.
Nate’s mother, Robyn Kirk, and his sister, Misty Hidaigo, also provided the officers with information. Specifically, that they believed Nate was the victim of foul play in that Ronald Riddell recently threatened Nate’s life.
On August 29, 2006 an MPD detective was assigned to the case to follow up on any and all details provided. The detective contacted Mr. Kirk, who told the detective that his son did not drown by accident but was murdered by Ron Riddell. Mr. Kirk provided the detective with background details concerning an argument between Mr. Riddell and Derrick Owens wherein his son intervened.
Also, on August 29, 2006 the detective contacted the Medical Examiner’s office and was advised that Nate’s autopsy was complete and that the cause of death was consistent with accidental drowning. However, the final determination regarding the cause of death was pending the results of toxicology.
On October 2, 2006 the MPD detective spoke with Mr. Kirk’s private investigator, Tim Cooning. Mr. Cooning advised the detective that he also had found no evidence that Nate’s death was anything but an accidental drowning.
On October 16, 2006, the official autopsy report was released by the Medical Examiner’s office with Nate’s cause of death listed as drowning. Additionally, the autopsy report indicated that at the time of his death, Nate had high levels of alcohol and cocaine in his system.
From the time of Nate’s death onward the detective assigned to the case received numerous telephone calls from Nate’s family and friends indicating that Nate’s death was not an accident. However, none of the individuals could substantiate their respective allegations.
On November 15, 2006 Ron Riddle, Sr., Ron Riddle, Jr. and Derrick Owens agreed to a voluntary interview at the MPD. Nothing was uncovered in the interviews to suggest that the Riddle’s or Owens had any involvement in Nate’s death.
The investigation also revealed that in or around October of 2004 Nate was involved in a fatal hit and run accident. On June 23, 2006, Nate was charged with Manslaughter in violation of Arizona Revised Statute 13-1103. Under Arizona law Manslaughter includes “recklessly causing the death of another.” Manslaughter is a class 2 felony, which is punishable by five (5) years in the state prison. On July 12, 2006 Nate was arrested on the warrant and lodged in the Maricopa County Jail pending arraignment on the charges. Subsequently, Nate appeared for arraignment on the charges and bond was set in the amount of fifty thousand dollars ($50,000.00). The case was scheduled for a jury trial on December 14, 2006 in Superior Court of Arizona for Maricopa County
On September 22, 2006 Nate was scheduled to appear in Superior Court before Judge Bethany G. Hicks for a status conference/change of plea. On September 23, 2006, the criminal case against Nate was dismissed due to his death.
Also, the investigation revealed that on November 27, 2005 the MPD responded to a police run at the Kirk residence concerning domestic violence. At that time, it was determined that Nate was involved in a dispute with a female friend. Again, on June 17, 2006 MPD responded to a police run to the Kirk residence concerning domestic violence. At that time, it was determined that Nate was involved in a dispute with his mother and sister. No charges were filed against Nate in either case.
The MPD has spent considerable time and resources on this investigation in addition to responding to numerous communications and has exhausted all investigative avenues to no avail. To continue to allocate our resources to this investigation would be a disservice to the citizens of the City of Mesa. However, in order to confirm the integrity of the MPD investigation, the results of which were corroborated by the Kirk’s private investigator, the MPD investigation was forwarded to the Maricopa County Attorney for investigative review.
I trust this satisfies your concerns. My sympathies are extended to the Kirk family.
Sincerely,
George Gascón
