Préval, His Excellency, Prime Minister, Jacques Edouard Alexis, Special UN Representative in Haiti, Mr. Edmond Mulet Director General of the Haitian Police, Mr. Mario Andresol His Excellency, Minister of the Interior, Mr. Paul Antoine Bien Aimé High Commissioner For Human Rights, UN, Ms. Louise Arbour Chief of Human Rights, MINUSTAH, Mr. Thierry Fagart cc: Mr. Gary Rex, US Embassy In Haiti, Ms. Carolina Hernandez Ramirez, OEA/Human Rights, Ms. Caroline Ouellet, Canadian Embassy, French Embassy in Haiti, Brasilian Embassy in Haiti, Mr. Gerardo Ducos, Amnesty International, Front Line We, the Association of the Academics Motivated for a Haiti With Rights, AUMOHD, Haiti Solidarity Network of the Northeast- HSNW, Human Rights Accompaniment in Haiti-HURAH, Organization for the Development and Respect for Democracy -ODRED Organization of the People for the Development of Bois Neuf-OPODEV Organization for the Reconstruction of Education of Vareux-OREV SOS Environment-SOS Development of Cité Soleil League of Pastors of Cité Soleil-LPCS Association of School Directors of Cité Soleil-SOSED Association of Women Victims of Cité Soleil-AFEVICS, Association of Distressed Students of Cité Soleil-ASEECISO, Association of Volunteers for International Service-AVSI Community Council For Human Rights (CHRC): Cité Soleil, Simon Pele, Croix des Bouquets, and Martissant/Gran Ravin, LAMP After having met on the 17, 26, 31 of January and on February 3, 2007 to ****yze the imminent danger to which the civilian population of Cité Soleil and Martissant is exposed by the legal VIOLENCE carried out by the soldiers of the Mission of the United Nations for Stabilization in Haiti, MINUSTAH, Have the honor to present to you the following: Considering the socioeconomic situation of the population of Cité Soleil, this vast shantytown inhabited by more than 300,000 people scorned, excluded, demonized with all kinds of malicious and disrespectful words, Considering that this SUBHUMAN situation has given rise subsequently within this population to some behaviors often considered to be unacceptable, even condemnable, Conscious that there exist in Cité Soleil illegal and dangerous armed groups which endanger the lives and the property of a whole CIVILIAN population, and thus that a RATIONAL and lasting resolution deserves to be developed so that these illegally armed groups will no longer be able to inflict harm, all the while without endangering their LIVES, Noting that, however, the interventions of the soldiers of the MINUSTAH, based in Cité Soleil are seen to be always deadly, UNCONTROLLED, not planned, not having a clear target, thus making innocent victims from the ranks of the civilian population, BY WAY OF EXAMPLE: Considering that on six July (6), 2005, more than thirty (30) people were killed by the soldiers of the MINUSTAH at the time of an intervention carried out at Bois Neuf, among which people, some innocent children and women who have nothing to do with violence, Considering that on Saturday, nine April (9), 2005, little Fedia RAPHAEL, 15 years old was shot dead at 8 o’clock in the morning at Projet Droullard, (ref.. her Mother Philiane ALTEUS); Considering that on January 4, 2006 Ms. Annette MOLERON, mother of eight (8) children, identified with the number: 0707-99-1961-07-00023 was killed (shot) in Bois Neuf, Cité Soleil by the Jordanian soldiers of the MINUSTAH. (ref. her Husband, Dieuno EDME); Considering that on fifteen April (15), 2005 Mr. Jean BEREL JEAN, father of five (5) children was killed (shot) by the soldiers of the MINUSTAH; Considering that on November 24, 2005 Mr. Lessone DOCIUS, father of six (6) children was killed (shot) on the construction site of his work at Drouillard, (Ref.his brother, Renal DOCIUS); Considering that on February 1, 2006 Mr. George, COLBERT, shoe shiner, 18 years old, was victim of several projectiles by the Jordanian soldiers of the MINUSTAH and subsequently underwent an amputation of his right testicle; Considering that February 1, 2006 at 9 o’clock in the morning Mr. Mesilhomme JOSEPH, 30 years old of a home builder, father of three (3) children was victim of several projectiles on his spinal column and the bottom of his left chest by the Jordanian soldiers of the MINUSTAH in Cité Soleil whereas he was on the way to go to work; Considering that on January 17, 2006 Charles LOUIDIA, a baby, a sixteen (16) month old was victimized in Cité Soleil (Drouillard project) on his left hip at the time of a confrontation between armed people and soldiers with the MINUSTAH; Considering that on four January (4), 2006, Mélan LUNDY, a nine year old child (9) was victimized at the Bois Neuf market, as he was going to buy coal for his mother at the time of an intervention of the Jordanian soldiers of the MINUSTAH, currently he is carrying a bullet in his right wrist (ref. his/her mother, Marie Lonise LUNDY.) ; Considering that on six July (6), 2005 Mr. Ladouceur NICOLAS, a handicapped person walking using crutches, father of three (3) children, was victim of several projectiles by the soldiers of the MINUSTAH at the time of an intervention of the latter in Drouillard. Considering that on six July (6), 2006 Ms. Édeline PIERRE LOUIS, 30 years old, mother of 5 children a piece worker was victim of several projectiles inside her own house and as a consequence, lost a 7 month old foetus that she was carrying; Considering that on May 25, 2005 Mr. Brice OSNER, father of 3 small children of a piece worker was victimized by 3 projectiles in the right arm in Cité Reno and underwent an amputation of his right arm; Considering that on December 22, 2006 at the time of an intervention of the soldiers of the MINUSTAH, more than twenty (20) people were killed among them members of the civilian population in particular Ms. Mercina Lelene, a pregnant woman currently hospitalized at the hospital Sainte Catherine of Bois Neuf; Considering that Friday February 2, 2007, a whole family, was attacked in Boston by the soldiers of the MINUSTAH including two young girls, Alexandra 7 years old and Stephanie LUBIN, 4 years old killed at once, and Mercius LUBIN and Marie Daniel REMY, husband and wife both currently hospitalized at the hospital Sainte Catherine; Recalling that the right to life is recognized by the Haitian constitution currently in force and consecrated by the Universal Declararation of human rights in article 3 which stipulates that EVERY individual has the right to the LIFE... Recalling that summary execution, systematic slaughter, yes, even the death penalty in whatever form that it might be, ARE PROHIBITED and ABOLISHED by the Constitution of March 29, 1987, by the Universal Declaration of the Human Rights and by Haitian laws: Recalling that the international Pact of the civil and political laws in its article 3 and following stipulates that the right to the LIFE is INHERENT to the human person. This right must be protected by the law. Therefore, no one can be arbitrarily deprived of LIFE no matter what the circumstances, Recalling that the United Nations, at the time of its 55th plenary meeting on November 10, 1998 in its General Assembly adopted resolution 53/25 has devoted the decade of 2001 /2010, as the International Decade of the Promotion of a Culture of Non Violence and Peace for the Benefit of the World; Recalling that resolution 52/15 of November 20, 1997, that of 1997/47 of the Economic and Social Council, on July 22, 1997, proclaiming year 2000 international Year of the culture of peace like its resolution 52/13 of November 20, 1997, relative to a culture of peace, are all in theory for peace and NON-VIOLENCE; Noting that in practice the Mission of the United Nations for Stabilization in Haiti, MINUSTAH, a branch of the same organization, the United Nations, has exceeded not only its fundamental mission, which is to be a force accompanying the Haitian National Police to maintain peace, with deadly interventions endangering WILLFULLY at times the life of the unhappy innocent poor, but also has SYSTEMATICALLY violated all these resolutions relating to peace and NON-VIOLENCE; Steadfastly in the face of this entire PAINFUL and ALARMING report, We, the signatories of the present petition propose as a solution: 1. A suspension of all interventions and/or armed operations by the soldiers of the MINUSTAH in Cité Soleil while waiting for a citizens’, comprehensive, non-violent solution 2. Creation in urgency of a multisector commission composed of the Haitian State (three branches), MINUSTAH, the Civil Society of the Cité Soleil and Martissant, organizations of national and international human rights acting as arbitrators; Which multisector commission will have the role first of making a serious, non partisan evaluation of the real situation of Cité Soleil and Martissant with a view toward a humane, appropriate, just solution, 3. A visible presence of the State in Cité Soleil and Martissant, with the presence of the MINUSTAH as forces accompanying the National police force of Haiti and not as a direct intervention force, Done at Port-Au-Prince on February 3 2007 Following are the signatures: 1. Sa mère Philiane ALTEUS) ; Considérant que le 4 Janvier 2006, la dame Annette MOLERON, mère de huit (8) enfants, identifiée au numéro CIN: 0707-99-1961-07-00023 a été tuée (fusillée), à Bois neuf Cité Soleil par les soldats Jordaniens de la MINUSTAH. (Réf. son Mari, Dieuno EDME) ; Considérant que le quinze (15) avril 2005, le sieur Jean BEREL JEAN, père de cinq (5) enfants, a été tué (fusillé) par les soldats de la MINUSTAH; Considérant que le 24 Novembre 2005, le Sieur Lessone DOCIUS, père de six (6) enfants, a été tué (fusillé) sur son chantier à projet Drouillard, (Réf. son frère, Renal DOCIUS), Considérant que le 1er Février 2006, le Sieur Georges, COLBERT, un cireur de chaussures, âgé de 18 ans, a été victime de plusieurs projectiles par les soldats Jordaniens de la MINUSTAH et a subi subséquemment une amputation de son testicule droit; Considérant que 1er Février 2006, à 9 heures du matin, le Sieur Mesilhomme JOSEPH, âgé de 30 ans de profession constructeur de maison, père de trois (3) enfants a été victime de plusieurs projectiles au niveau de sa colonne vertébrale et au bas de sa poitrine gauche par les soldats jordaniens de la MINUSTAH à Cite Soleil, alors qu’il était en route pour aller faire son ouvrage; Considérant que le 17 Janvier 2006, Charles LOUIDIA, un bébé de seize (16) mois a été victime à cite Soleil (projet Drouillar) au niveau de sa hanche gauche lors d’un affrontement entre des gens armes et des soldats de la MINUSTAH; Considérant que le quatre (4) Janvier 2006, Mélan LUNDY, un enfant de neuf ans (9), a été victime au marché de Bois Neuf, alors qu’il allait acheter du charbon pour sa mère, au moment d’une intervention des soldats Jordaniens de la MINISTAH. Actuellement, il porte une cartouche à son Poignet droit (Réf. sa mère, Marie Lonise LUNDY.) ; Considérant que le six (6) Juillet 2005, le sieur Ladouceur NICOLAS, un handicape marchant à l’aide des béquilles, père de trois (3) enfants, a été victime de plusieurs projectiles par les soldats de la MINUSTAH lors d’une intervention de ces derniers à Droillard. Considérant que le six (6) Juillet 2006, la dame Edeline PIERRE LOUIS, âgée de 30 ans, mère de 5 enfants de profession petite détaillante, a été victime de plusieurs projectiles à l’intérieur même de sa maison et en conséquence, a perdu un foetus de 7 mois qu’elle portait; Considérant que le 25 Mai 2005, le Sieur Brice OSNER, père de 3 enfants, de profession petit détaillant a été victime par 3 projectiles au bras droit à Cité Reno (Cité Soleil) et a subi une amputation de son bras droit; Considérant que le 22 Décembre 2006, lors d’une intervention des soldats de la MINUSTAH, plus de vingt (20) personnes auraient été tuées, d’autres grièvement blessées parmi eux des membres de la population Civile, notamment : la dame Mercina Lelene, une femme enceinte actuellement hospitalisée à l’hôpital Sainte Catherine de Bois Neuf; Considérant que le Vendredi 2 Février 2007, une famille entière a été attaquée à Boston par les soldats de la MINUSTAH dont deux fillettes : Alexandra et Stéphanie LUBIN respectivement âgées de 7 ans et 4 ans tuées sur le champ ; leurs père et mère Mercius LUBIN et Marie Daniel REMY, tous deux actuellement hospitalisés à l’hôpital Sainte Catherine; Rappelant que le droit à la vie est reconnue par la constitution haïtienne actuellement en vigueur et consacrée par la Déclaration Universelle des droits de l’homme en son articles 3 qui stipule que TOUT individu a droit à la VIE… Rappelant que l’exécution sommaire, la tuerie systématique voire la peine de mort sous quelque forme que ce soit sont PROHIBEES et ABOLIES par la Constitution du 29 Mars 1987, par la Déclaration Universelle des droits de l’homme et par les lois haïtiennes: Rappelant que le Pacte international des droits civils et politiques dans ses articles 3 et suivants stipule que le droit à la VIE est INHERENT à la personne humaine. Ce droit doit être protégé par la loi. Donc, nul ne peut être arbitrairement privé de sa VIE, SOUS QUELQUE FORME QUE CE SOIT; Rappelant que les Nations Unies, lors de sa 55e séance plénière tenue le 10 novembre 1998 par l’Assemblée Générale a adopté la résolution 53/25 a consacré la décennie 2001 /2010 Décennie internationale pour la promotion d’une culture de la Non Violence et de la Paix au Profit du monde; Rappelant que les résolutions 52/15 du 20 novembre 1997 celle de 1997/47 du Conseil économique et social, en date du 22 juillet 1997, proclamant l’an 2000 Année internationale de la culture de la paix ainsi que la résolution 52/13 du 20 novembre 1997, relative à une culture de la paix, sont toutes en théorie pour la paix et la NON VIOLENCE; Constatant qu’en pratique la Mission des Nations Unies pour la Stabilisation en Haïti, MINUSTAH, une branche de cette même organisation des NATIONS UNIES a non seulement outrepassé sa mission fondamentale qui est : une force d’accompagnement de la Police Nationale d’Haïti et de maintient de paix par des interventions meurtrières mettant en danger des fois VOLONTAIREMENT la vie des pauvres innocents malheureux mais aussi a violé SYSTEMATIQUEMENT toutes ces résolutions prise par les Nations Unies relatives à la paix et à la NON VIOLENCE; Fort de ce constat DOULOUREUX et PREOCCUPANTE, Nous, les signataires de la présente, proposons en guise de solution: 1. Un sursis de toutes interventions et/ou opérations armées des soldats de la MINUSTAH à Cite Soleil en attendant une solution CITOYENNE concertée et Non Violente. 2. La création en urgence d’une commission multisectorielle dont: l’Etat Haïtien (les trois Pouvoirs), la MINUSTAH, la Société Civile de la Communauté de Cite Soleil et de Martissant, les organisations des droits humains nationaux et internationaux. Laquelle commission multisectorielle aura pour mission première de faire une évaluation sérieuse et Non partisane de la situation réelle de Cite Soleil et de Martissant en vue d’une solution juste, humaine et appropriée; 3. Une présence manifeste de l’Etat Haïtien à Cite Soleil et à Martissant, avec la présence de la MINUSTAH comme force d’accompagnement à la police Nationale d’Haïti et non comme force d’intervention directe.
