		<description>It is so sad when an Institution that the citizens put in place to uphold the law refuses to do just that.  THE MICHIGAN DEPARTMENT OF CORRECTION AND THE PAROLE BOARD are abusing their discretion, so much so that the LEGISLATURE has written a bill to force them to stop abusing their discretion. Senate Bill 1207 introduced by Senator Michael Switalski and Senator Martha Scott states that the PAROLE BOARD SHALL CONSIDER THE PRISONER FOR RELEASE ON PAROLE BASED ON THE CRITERIA USED TO EVALUATE ALL OTHER PRISONERS. Including the calculation of Parole Guidelines Score, Pursuant to Section 33E. The fact that the prisoner is serving a sentence of life shall not negatively affect the prisoner&rsquo;s parole guideline score. 

      The bill was written because the MICHIGAN DEPARTMENT OF CORRECTION AND THE PAROLE BOARD are refusing to consider parolabale lifers seriously. This injustice has been overlooked now for long enough!

      The Criminal Defense Newsletter Volume 17, Number 4 January 1994, is when the truth came out. Life means Life, Parole is rarely granted on Non-mandatory life terms. The Michigan Supreme Court held that lifer sentences under second degree are not mandatory life terms, and are not meant to be served as such. 

      People vs. Moore 432 Michigan 311, 317-325 (1989). Under the Lifer&rsquo;s Law, Parolable Lifer&rsquo;s come under the jurisdiction of the Parole Board after serving ten years if sentenced before 1992 and 15 years if sentenced after 1992. Which means you are Eligible for parole after serving the minimum time requirement.  The Michigan Department of Corrections Openly acknowledges its position that: &ldquo;The Lifer Law is rarely used and Prisoners should never expect there is any Guarantee they will be considered for it!&rdquo; You are Incorrect In Your Assumption that we think Parolable Lifer&rsquo;s are required to serve 20 calendar years. Clearly they are required to serve life!  The Michigan Department and Parole Board taking this position is the reason why Michigan Legislators had to create this bill to force the Michigan Department of Correction and The Parole Board to follow the law as it was intended to be.

      We are asking you to sign this petition to get this bill passed so justice can be served to all the prisoners who are eligible for Parole, but are not even being considered for it. To hear the Department of Correction say that we should never even expect to be considered for the Lifer&rsquo;s Law is so unjust!

			<description>Its about time these inmates be released and given a chance at life.  My fiance&amp;#039; has been in the MDOC since he was 17- he will be 60 in January for a crime he commited at 17.  He is serving a 2nd degree life sentence and has one of the best record in the state.  There is no reason for him to still be in the MDOC.</description>
