    After having met on the 17, 26, 31 of January and on February 3, 2007 to analyze the imminent danger to which the civilian population of Cit&eacute; Soleil and Martissant is exposed by the legal VIOLENCE carried out by the soldiers of the Mission of the United Nations for Stabilization in Haiti, MINUSTAH, 

Have the honor to present to you the following:

Considering the socioeconomic situation of the population of Cit&eacute; Soleil, this vast shantytown inhabited by more than 300,000 people scorned, excluded, demonized with all kinds of malicious and disrespectful words, 

Considering that this SUBHUMAN situation has given rise subsequently within this population to some behaviors often considered to be unacceptable, even condemnable, 

Conscious that there exist in Cit&eacute; Soleil illegal and dangerous armed groups which endanger the lives and the property of a whole CIVILIAN population, and thus that a RATIONAL and lasting resolution deserves to be developed so that these illegally armed groups will no longer be able to inflict harm, all the while without endangering their LIVES, 

Noting that, however, the interventions of the soldiers of the MINUSTAH, based in Cit&eacute; Soleil are seen to be always deadly, UNCONTROLLED, not planned, not having a clear target, thus making innocent victims from the ranks of the civilian population, 

BY WAY OF EXAMPLE: 

Considering that on six July (6), 2005, more than thirty (30) people were killed by the soldiers of the MINUSTAH at the time of an intervention carried out at Bois Neuf, among which people, some innocent children and women who have nothing to do with violence, 

Considering that on Saturday, nine April (9), 2005, little Fedia RAPHAEL, 15 years old was shot dead at 8 o&rsquo;clock in the morning at Projet Droullard, (ref.. her Mother Philiane ALTEUS); 

Considering that on January 4, 2006 Ms. Annette MOLERON, mother of eight (8) children, identified with the number: 0707-99-1961-07-00023 was killed (shot) in Bois Neuf, Cit&eacute; Soleil by the Jordanian soldiers of the MINUSTAH. (ref. her Husband, Dieuno EDME); 

Considering that on fifteen April (15), 2005 Mr. Jean BEREL JEAN, father of five (5) children was killed (shot) by the soldiers of the MINUSTAH; 

Considering that on November 24, 2005 Mr. Lessone DOCIUS, father of six (6) children was killed (shot) on the construction site of his work at Drouillard, (Ref.his brother, Renal DOCIUS); 

Considering that on February 1, 2006 Mr. George, COLBERT, shoe shiner, 18 years old, was victim of several projectiles by the Jordanian soldiers of the MINUSTAH and subsequently underwent an amputation of his right testicle; 

Considering that February 1, 2006 at 9 o&rsquo;clock in the morning Mr. Mesilhomme JOSEPH, 30 years old of a home builder, father of three (3) children was victim of several projectiles on his spinal column and the bottom of his left chest by the Jordanian soldiers of the MINUSTAH in Cit&eacute; Soleil whereas he was on the way to go to work; 

Considering that on January 17, 2006 Charles LOUIDIA, a baby, a sixteen (16) month old was victimized in Cit&eacute; Soleil (Drouillard project) on  his left hip at the time of a confrontation between armed people and soldiers with the MINUSTAH; 

Considering that on four January (4), 2006, M&eacute;lan LUNDY, a nine year old child (9) was victimized at the Bois Neuf market, as he was going to buy coal for his mother at the time of an intervention of the Jordanian soldiers of the MINUSTAH, currently he is carrying a bullet in his right wrist (ref. his/her mother, Marie Lonise LUNDY.) ; 

Considering that on six July (6), 2005 Mr. Ladouceur NICOLAS, a handicapped person walking using crutches, father of three (3) children, was victim of several projectiles by the soldiers of the MINUSTAH at the time of an intervention of the latter in Drouillard. 

Considering that on six July (6), 2006 Ms. &Eacute;deline PIERRE LOUIS, 30 years old, mother of 5 children a piece worker was victim of several projectiles inside her own house and as a consequence, lost a 7 month old foetus that she was carrying; 

Considering that on May 25, 2005 Mr. Brice OSNER, father of 3 small children of a piece worker was victimized by 3 projectiles in the right arm in Cit&eacute; Reno and underwent an amputation of his right arm; 

Considering that on December 22, 2006 at the time of an intervention of the soldiers of the MINUSTAH, more than twenty (20) people were killed among them members of the civilian population in particular Ms. Mercina Lelene, a pregnant woman currently hospitalized at the hospital Sainte Catherine of Bois Neuf; 

Considering that Friday February 2, 2007, a whole family, was attacked in Boston by the soldiers of the MINUSTAH including two young girls, Alexandra 7 years old and Stephanie LUBIN, 4 years old killed at once, and Mercius LUBIN and Marie Daniel REMY, husband and wife both currently hospitalized at the hospital Sainte Catherine; 

Recalling that the right to life is recognized by the Haitian constitution currently in force and consecrated by the Universal Declararation of human rights in article 3 which stipulates that EVERY individual has the right to the LIFE... 

Recalling that summary execution, systematic slaughter, yes, even the death penalty in whatever form that it might be, ARE PROHIBITED and ABOLISHED by the Constitution of March 29, 1987, by the Universal Declaration of the Human Rights and by Haitian laws: 

Recalling that the international Pact of the civil and political laws in its article 3 and following stipulates that the right to the LIFE is INHERENT to the human person. This right must be protected by the law. Therefore, no one can be arbitrarily deprived of LIFE no matter what the circumstances, 

Recalling that the United Nations, at the time of its 55th plenary meeting on November 10, 1998 in its General Assembly adopted resolution 53/25 has devoted the decade of 2001 /2010, as the International Decade of the Promotion of a Culture of Non Violence and Peace for the Benefit of the World; 

Recalling that resolution 52/15 of November 20, 1997, that of 1997/47 of the Economic and Social Council, on July 22, 1997, proclaiming year 2000 international Year of the culture of peace like its resolution 52/13 of November 20, 1997, relative to a culture of peace, are all in theory for peace and NON-VIOLENCE; 

Noting that in practice the Mission of the United Nations for Stabilization in Haiti, MINUSTAH, a branch of the same organization, the United Nations, has exceeded not only its fundamental mission, which is to be a force accompanying the Haitian National Police to maintain peace, with deadly interventions endangering WILLFULLY at times the life of the unhappy innocent poor, but also has SYSTEMATICALLY violated all these resolutions relating to peace and NON-VIOLENCE; 

Steadfastly in the face of this entire PAINFUL and ALARMING report, We, the signatories of the present petition propose as a solution: 

1. A suspension of all interventions and/or armed operations by the soldiers of the MINUSTAH in Cit&eacute; Soleil while waiting for a citizens&rsquo;, comprehensive, non-violent solution  

2. Creation in urgency of a multisector commission composed of the Haitian State (three branches), MINUSTAH, the Civil Society of the Cit&eacute; Soleil and Martissant, organizations of national and international human rights acting as arbitrators; Which multisector commission will have the role first of making a serious, non partisan evaluation of the real situation of Cit&eacute; Soleil and Martissant with a view toward a humane, appropriate, just solution, 

3. A visible presence of the State in Cit&eacute; Soleil and Martissant, with the presence of the MINUSTAH as forces accompanying the National police force of Haiti and not as a direct intervention force,

Apr&egrave;s avoir r&eacute;uni les 17, 26, 31 Janvier et le 3 F&eacute;vrier 2007 pour analyser le danger imminent auquel est expos&eacute;e la population civile de Cit&eacute; Soleil et de Martissant face &agrave; la VIOLENCE l&eacute;gale exerc&eacute;e par les soldats de la Mission des Nations Unies pour la Stabilisation en Ha&iuml;ti, MINUSTAH, 
 
              Avons l&rsquo;honneur de vous pr&eacute;senter  ce qui suit:
 
Consid&eacute;rant la situation socio &eacute;conomique  de la population de Cit&eacute; Soleil, ce vaste bidonville habit&eacute; par plus de 300. 000 habitants  m&eacute;pris&eacute;s, exclus, diabolis&eacute;s de tous les mots m&eacute;chants et irrespectueux,
 
Consid&eacute;rant que cette situation INFRAHUMAINE a cr&eacute;e subs&eacute;quemment sur cette population des comportements souvent jug&eacute;s non acceptables voire condamnables,
 
Conscient qu&rsquo;il existe &agrave; Cite Soleil des groupes arm&eacute;s ill&eacute;gaux et dangereux qui mettent en danger les vies et les biens de toute une POPULATION CIVILE, donc, un  contr&ocirc;le RATIONNEL et durable m&eacute;rite d&rsquo;&ecirc;tre envisag&eacute; pour mettre hors d&rsquo;&eacute;tat de nuire ces groupes arm&eacute;es ill&eacute;gaux, sans porter toutefois atteinte &agrave; leur VIE,
 
Constatant que cependant, les interventions des soldats de la MINUSTAH, bas&eacute;es  &agrave; Cite Soleil se sont r&eacute;v&egrave;lees toujours meurtri&egrave;res, incontr&ocirc;l&eacute;es non planifi&eacute;es, n&rsquo;ayant pas vraiment de cible propre, faisant ainsi des victimes innocents dans le rang de la population civile,
 
A TITRE D&rsquo;EXEMPLE:
 
Consid&eacute;rant que le six (6) Juillet 2005, plus de trente (30) personnes ont &eacute;t&eacute; tu&eacute;es par les soldats de la MINUSTAH lors d&rsquo;une intervention men&eacute;e &agrave; Bois Neuf ; parmi ces personnes des enfants et des femmes enceintes innocents qui n&rsquo;avaient rien &agrave; voir avec la violence,
 
Consid&eacute;rant que le Samedi neuf (9) Avril 2005, la petite Fedia RAPHAEL, &acirc;g&eacute;e de 15 ans a &eacute;t&eacute; fusill&eacute;e &agrave; mort &agrave; 8 heures du matin &agrave; Projet Droullard, ( R&eacute;f. Sa m&egrave;re Philiane ALTEUS) ;
 
 
Consid&eacute;rant que le 4 Janvier 2006, la dame Annette MOLERON, m&egrave;re de huit (8) enfants, identifi&eacute;e au num&eacute;ro CIN: 0707-99-1961-07-00023 a &eacute;t&eacute; tu&eacute;e (fusill&eacute;e), &agrave; Bois neuf Cit&eacute; Soleil par les soldats Jordaniens de la MINUSTAH. (R&eacute;f. son Mari, Dieuno EDME) ;
Consid&eacute;rant que  le quinze (15) avril 2005, le sieur Jean BEREL JEAN, p&egrave;re de cinq (5) enfants, a &eacute;t&eacute; tu&eacute; (fusill&eacute;) par les soldats de la MINUSTAH;

Consid&eacute;rant que le 24 Novembre 2005, le Sieur Lessone DOCIUS, p&egrave;re de six (6) enfants, a &eacute;t&eacute; tu&eacute; (fusill&eacute;) sur son chantier &agrave; projet Drouillard, (R&eacute;f. son fr&egrave;re, Renal DOCIUS), 

Consid&eacute;rant que le 1er F&eacute;vrier 2006, le Sieur Georges, COLBERT, un cireur de chaussures, &acirc;g&eacute; de 18 ans, a &eacute;t&eacute; victime de plusieurs projectiles par les soldats Jordaniens de la MINUSTAH et a subi subs&eacute;quemment une amputation de son testicule droit;

Consid&eacute;rant que  1er  F&eacute;vrier 2006, &agrave; 9 heures du matin, le Sieur Mesilhomme JOSEPH, &acirc;g&eacute; de 30 ans de profession constructeur de maison, p&egrave;re de trois (3) enfants a &eacute;t&eacute; victime de plusieurs  projectiles au niveau de sa colonne vert&eacute;brale et au bas de sa poitrine gauche par les soldats jordaniens de la MINUSTAH &agrave; Cite Soleil, alors qu&rsquo;il &eacute;tait en route pour aller faire son ouvrage;

Consid&eacute;rant que  le 17 Janvier 2006, Charles LOUIDIA, un b&eacute;b&eacute; de seize (16) mois a &eacute;t&eacute; victime &agrave; cite Soleil (projet Drouillar) au niveau de sa hanche gauche lors d&rsquo;un affrontement entre des gens armes et des soldats de la MINUSTAH;

Consid&eacute;rant que le quatre (4) Janvier 2006, M&eacute;lan LUNDY, un enfant de neuf ans (9), a &eacute;t&eacute; victime au march&eacute; de Bois Neuf, alors qu&rsquo;il allait acheter du charbon pour sa m&egrave;re, au moment d&rsquo;une intervention des soldats Jordaniens de la MINISTAH. Actuellement, il porte une cartouche &agrave; son Poignet droit (R&eacute;f. sa m&egrave;re, Marie Lonise LUNDY.) ;

Consid&eacute;rant que  le six (6) Juillet 2005, le sieur Ladouceur NICOLAS, un handicape marchant &agrave; l&rsquo;aide des b&eacute;quilles, p&egrave;re de trois (3) enfants, a &eacute;t&eacute; victime de plusieurs projectiles par les soldats de la MINUSTAH lors d&rsquo;une intervention de ces derniers &agrave; Droillard. 

Consid&eacute;rant que le six (6) Juillet 2006, la dame Edeline PIERRE LOUIS, &acirc;g&eacute;e de 30 ans, m&egrave;re de 5 enfants de profession petite d&eacute;taillante, a &eacute;t&eacute; victime de plusieurs projectiles &agrave; l&rsquo;int&eacute;rieur m&ecirc;me de sa maison et en cons&eacute;quence, a perdu un foetus de 7 mois qu&rsquo;elle portait;  
Consid&eacute;rant que  le 25 Mai 2005, le Sieur Brice OSNER, p&egrave;re de 3 enfants, de profession petit d&eacute;taillant a &eacute;t&eacute; victime par 3 projectiles au bras droit &agrave; Cit&eacute; Reno (Cit&eacute; Soleil) et a subi une  amputation de son bras droit;

Consid&eacute;rant que le 22 D&eacute;cembre 2006, lors d&rsquo;une intervention des soldats de la MINUSTAH, plus de vingt (20) personnes auraient &eacute;t&eacute; tu&eacute;es, d&rsquo;autres gri&egrave;vement bless&eacute;es  parmi eux des membres de la population Civile, notamment : la dame Mercina Lelene, une femme enceinte actuellement hospitalis&eacute;e &agrave; l&rsquo;h&ocirc;pital Sainte Catherine de Bois Neuf;

Consid&eacute;rant que le Vendredi 2 F&eacute;vrier 2007, une famille enti&egrave;re a &eacute;t&eacute; attaqu&eacute;e &agrave; Boston par les soldats de la MINUSTAH dont deux fillettes : Alexandra et St&eacute;phanie LUBIN respectivement &acirc;g&eacute;es de 7 ans et 4 ans tu&eacute;es sur le champ ; leurs p&egrave;re et m&egrave;re Mercius LUBIN et Marie Daniel REMY, tous deux actuellement hospitalis&eacute;s &agrave; l&rsquo;h&ocirc;pital Sainte Catherine;

Rappelant que le droit &agrave; la vie est reconnue par la constitution ha&iuml;tienne actuellement en vigueur et consacr&eacute;e par la D&eacute;claration Universelle des droits de l&rsquo;homme en son articles 3 qui stipule que TOUT individu a droit &agrave; la VIE&hellip;

Rappelant que l&rsquo;ex&eacute;cution sommaire, la tuerie syst&eacute;matique voire la peine de mort sous quelque forme que ce soit sont PROHIBEES et ABOLIES par la Constitution du 29 Mars 1987, par la D&eacute;claration Universelle des droits de l&rsquo;homme et par les lois ha&iuml;tiennes:

Rappelant que le Pacte international des droits civils et politiques dans ses articles 3 et suivants  stipule que le droit &agrave; la VIE est INHERENT &agrave; la personne humaine. Ce droit doit &ecirc;tre prot&eacute;g&eacute; par la loi. Donc, nul ne peut &ecirc;tre arbitrairement priv&eacute; de sa VIE, SOUS QUELQUE FORME QUE CE SOIT;

Rappelant que les Nations Unies, lors de sa 55e s&eacute;ance pl&eacute;ni&egrave;re tenue le 10 novembre 1998 par l&rsquo;Assembl&eacute;e G&eacute;n&eacute;rale a adopt&eacute; la r&eacute;solution 53/25 a consacr&eacute; la d&eacute;cennie 2001 /2010 D&eacute;cennie internationale pour la promotion d&rsquo;une culture de la Non Violence et de la Paix au Profit du monde;

Rappelant que les r&eacute;solutions 52/15 du 20 novembre 1997 celle de 1997/47 du Conseil &eacute;conomique et social, en date du 22 juillet 1997, proclamant l&rsquo;an 2000 Ann&eacute;e internationale de la culture de la paix ainsi que la r&eacute;solution 52/13 du 20 novembre 1997, relative &agrave; une culture de la paix, sont toutes en th&eacute;orie pour la paix et la NON VIOLENCE;

Constatant qu&rsquo;en pratique la Mission des Nations Unies pour la Stabilisation en Ha&iuml;ti, MINUSTAH, une branche de cette m&ecirc;me organisation des NATIONS UNIES a non seulement outrepass&eacute; sa mission fondamentale qui est : une force d&rsquo;accompagnement  de la Police Nationale d&rsquo;Ha&iuml;ti et de maintient de paix par des interventions meurtri&egrave;res mettant en danger des fois VOLONTAIREMENT la vie des pauvres innocents malheureux mais aussi a viol&eacute; SYSTEMATIQUEMENT toutes ces r&eacute;solutions prise par les Nations Unies relatives &agrave; la paix et &agrave; la NON VIOLENCE;

Fort de ce constat DOULOUREUX et PREOCCUPANTE,

Nous, les signataires de la pr&eacute;sente, proposons en guise de solution:
 
1.     Un sursis de toutes interventions et/ou op&eacute;rations arm&eacute;es des soldats de la MINUSTAH &agrave; Cite Soleil en attendant une solution CITOYENNE concert&eacute;e et Non Violente.
 
2.     La cr&eacute;ation en urgence d&rsquo;une commission multisectorielle dont: l&rsquo;Etat Ha&iuml;tien (les trois Pouvoirs), la MINUSTAH, la Soci&eacute;t&eacute; Civile de la Communaut&eacute;  de Cite Soleil et de Martissant, les organisations des droits humains nationaux et internationaux. Laquelle  commission multisectorielle aura pour mission premi&egrave;re de faire une &eacute;valuation ...</description>

			<description>The MINUSTAH forces are led by an army whose only merit to this day has been not fighting enemy armies, but the brutal repression, together with the military police it  has commanded, firstly of the slave population of Brazil, and later, after the abolition of slavery in 1888, of their descendants in the favelas. Let it not do the same in Haiti.</description>
